Looking for clarity?: 

The new rules on Transfers, which now include changing contractors, are progressively coming into force.  Here are some hot tips. 

  1. Individuals who had a pension, who transfer to you, have to have some kind of pension (but not necessarily what they had before). Click here for your free download on TUPE and pensions.
  2. New employers are now entitled to demand information about the existing workforce.  This includes the information that should be on a statement of particulars of employment (or in documents issued instead).  Click here for your free checklist of what the statement should include.   
  3. New employers are also entitled to additional information - email us for the additional list of TUPE information.
  4. Both old and new employers will need to consult employee representatives about the effect of the transfer and any proposed changes and there are special (and restricted) rules on when and how you can change contractual terms.   Contact us for more information.

The new rules on Age Discrimination are due to come into force on 1st October.

  1. You will be required to give notification of retirement dates at least 6 months in advance, and give the employee the chance to ask to work beyond retirement.  To be on the safe side, do this NOW for employees due to retire at the end of 2006.
